BODYTONE INTERNATIONAL SPORT S.L., with registered office at C/ Legón 4, 30500, Molina de Segura (Murcia), with tax ID (CIF) B-73591109, provides its online sales services over the Internet through its website http://www.bodytone.eu. Its contact email address is info@bodytone.eu. Its contact telephone number is 968 20 53 83. The address for the purposes of complaints is the one stated as the company's registered office.

These General Terms and Conditions (hereinafter the General Conditions) govern the commercial relationship arising between BODYTONE INTERNATIONAL SPORT S.L. and the user or customer through purchases made using the forms that BODYTONE INTERNATIONAL SPORT S.L. makes available on its website/online store http://www.bodytone.eu

Purchasing through the website/online store of BODYTONE INTERNATIONAL SPORT S.L. implies acceptance of these General Conditions by the customer or user, as well as of the conditions of use established for the user's browsing of the pages owned by BODYTONE INTERNATIONAL SPORT S.L. These conditions apply without prejudice to the legal rules on the matter that apply in each case.

These General Conditions are subject to Law 7/1998 of 13 April on General Contract Conditions, Organic Law 3/2018 of 5 December on Personal Data Protection and the guarantee of digital rights, Law 7/1996 of 15 January on the Regulation of Retail Trade, and Law 34/2002 of 11 July on Information Society Services and Electronic Commerce.

BODYTONE INTERNATIONAL SPORT S.L. reserves the right to make any changes it deems appropriate to the General Conditions, without prior notice. Such changes may be made through its website/online store, by any means admissible in law, and shall be binding for as long as they are published on the website and until they are validly modified by subsequent ones. Nevertheless, BODYTONE INTERNATIONAL SPORT S.L. reserves the right to apply, in certain cases, Special Contract Conditions in preference to these General Conditions when it considers it appropriate, announcing them in due time and form.

Use of the website confers the status of User and implies acceptance of the general conditions, the privacy policy and the conditions of use. If the User does not agree, they shall refrain from using the website. The User undertakes and agrees not to transmit, disseminate or make available to third parties any content of the website, such as information, texts, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software, logos, trademarks, icons, technology, links, graphic design and source code, or any other material to which they may have access as a User of the Website, this list not being exhaustive.

Once registered as such on the website/online store, which is required in order to purchase the products offered through it, the User has a personal area called “My Account”. There they can access the link “View or edit your details” and thus identify and correct any errors made when entering data.

When the customer places an order, they will receive at the email address they have provided an email with the web order request, listing all the products they wish to purchase, the purchase prices and a link through which they can consult these terms and conditions of purchase. Once the order request has been made, it will be processed and the customer will receive a second confirmation email with the information relating to their order. If any situation arises relating to stock, changes in delivery time, etc., the company will contact the User or customer by email or telephone to keep them informed at all times.

The order confirmation may be printed by the user as proof of purchase, but shall under no circumstances be valid as an invoice.

The order will be accompanied by the invoice upon delivery to the delivery address. In the “My Orders” section, located on the main page within the “My Account” section, the customer/user will also find a history of all orders placed with BODYTONE INTERNATIONAL SPORT S.L. By clicking on the order number they will find the list of products purchased, the price and the payment method.

All documentation provided to the customer will be in Spanish.

Shipping costs are calculated according to the number of items of each class added to the cart. Therefore, the shipping cost takes into account the different volume classes and the number of items in the cart belonging to each of these classes.

Below you will see the default rates, which decrease according to the number of items added to the basket.

The weight is less than 2 kg  and the dimensions are less than  350 x 230 x 30mm

Size M. Cost €7.69

The weight of the item is between 2-30kg and the dimensions are less than 150cm (L x W x H)

Size L. Cost €11.19

The weight of the item is more than 30kg and the dimensions are less than 150cm (L x W x H)

Size XL. Cost €14.29

The weight of the item is more than 30kg and the dimensions are more than 150cm (L x W x H)

Delivery types:

-. KERBSIDE DELIVERY

This is the default delivery method. If your order weighs less than 40kg, we will very likely deliver it to your home. If it weighs more, we will arrange with you delivery to the entrance of your home or apartment block. Remember that you will have to move and install the equipment yourself.

-. HOME DELIVERY PLUS PERSONALISED INSTALLATION (ENQUIRE)

This method includes delivery to your home plus immediate installation of the equipment. It is normally recommended for heavy or bulky products and for home gyms that include several machines. We will bring the machine(s) to the agreed place and time, install and test all the machines and take the packaging away to a recycling point. It is best to contact us on 968 20 53 83 for a personalised quote.

If you notice that your order shows signs of having been knocked by the courier, that the packaging has arrived damaged or shows signs of having been tampered with, please contact us within 48 hours of receipt so that we can open a claim with the courier and claim for the damage. Please remember that after this period the carrier will not take responsibility for any damage. You must keep the outer packaging of the order and the label, and take photos to provide to the courier company.

Bodytone.eu offers you several payment methods so that you can choose the one that suits you best or best fits your needs:

• Credit card payment: you can use Visa or MasterCard. If you pay with a VISA or Mastercard card, your card will be charged at the time of purchase, that is, when the order is processed. If our virtual payment terminal reports that the card has been declined, the order will be cancelled automatically and the customer will be informed online of the cancellation. For payments made with cards issued outside Spain, the issuing bank must be adhered to the Secure Electronic Commerce (CES) Security Protocol. Bodytone.eu reserves the right to reject any transaction made by credit card. In this case we will refund the money to the original card. In such cases, if the customer wishes to proceed with the purchase of the items, we will request a bank transfer.

• Payment by bank transfer: This payment method is limited to orders over 150 euros. You can make a bank transfer to any of the following accounts:

It is very important that in the SENDER or ORDERING PARTY field you state the following: Order no. – Your first name and surname

You have a period of 7 working days to arrange the transfer after placing your order. The order will not be considered effective until we confirm the corresponding payment, and therefore delivery times start counting from that date.

Select this payment method, complete the information required by Paga+Tarde and choose the number of instalments over which you want to finance your purchase. No paperwork! Bodytone has no control over the outcome of the application, Paga+Tarde being solely responsible for the credit and its conditions.

If your application is approved, they will inform you with complete transparency of the amount you will pay in each instalment, as well as the interest rate (APR) that will apply to your credit. All instalments are fixed and equal to each other. There are no additional charges or fees of any kind. You will only pay the amounts indicated according to the instalments selected.

• Payment by PayPal: The most secure online standard for making your payments.

For each product, the user or customer will be able to see the estimated shipping time (in working days) for that product. Saturdays, Sundays and national, regional and local public holidays are not included in the shipping time.

The delivery period will correspond to that of the item with the longest delivery period. Any delays that may occur will be communicated by BODYTONE INTERNATIONAL SPORT S.L. by email.

The availability of the products offered by BODYTONE INTERNATIONAL SPORT S.L. through its website may vary depending on customer demand. Although the company updates its stock periodically, the product requested by the customer may be sold out at that moment. In that case, BODYTONE INTERNATIONAL SPORT S.L. will send the customer an email with all the information on stock and delivery times that the company can provide.

If the order contains other products in addition to the one affected by the lack of availability, the customer/user may cancel the entire order if they wish, or confirm the order excluding the affected product.

The refund for the affected products will be processed at the time the lack of availability is communicated, and will be reflected in your account without delay.

9.1 Returns procedure

BODYTONE INTERNATIONAL SPORT S.L. offers you up to 14 calendar days to withdraw from your purchase.
During the first 14 days from receipt of the goods you may return the product(s) and Bodytone will refund the full amount without undue delay.
The refund period will be the 14 days following the date on which Bodytone was informed of the decision to withdraw. However, the company may withhold the refund until it has received the goods or until the customer provides proof of their return, whichever occurs first.
To exercise your right of withdrawal, the withdrawal form is available, which you must send to the email address atencionalcliente@bodytone.eu.

9.2 Notes on returns

The customer shall bear the direct costs of returning the goods.
You must return the product(s) without undue delay and, in any case, no later than 14 calendar days from the date on which you communicate your decision to withdraw from the contract.
Once the goods are received, they will be inspected by the relevant department and the amount will be refunded.
Only products in perfect condition will be accepted, and returns of products that are not perfectly sealed will not be accepted. The customer shall be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
BODYTONE INTERNATIONAL SPORT S.L. will not accept returns of products that have been tampered with by the customer. The right of withdrawal shall not apply outside the stated period, nor to products subject to fluctuations in a market not controlled by Bodytone, nor to perishable goods, nor to items that can easily be reproduced immediately, such as software or packs made up of or including them. Withdrawal shall also not apply to goods or orders that, owing to their special characteristics, may be considered made to the customer's specifications. All of this in accordance with Royal Legislative Decree 1/2007 of 16 November approving the Consolidated Text of the General Law for the Protection of Consumers and Users (hereinafter TRLGDCU).
In accordance with Article 103 TRLGDCU, the following items are excluded from the right of withdrawal:
Due to their protective nature, unsealed software or software without its original wrapping, books and products with free software on which it has been registered.
Due to their hygienic nature, any product that cannot be resold, such as mats or foam rollers, as well as any product that comes into direct contact with body sweat.

9.3 Instructions for returning products

Returned goods must be wrapped and packed securely in their original packaging and covered by outer packaging, with all their accessories and showing no signs of use. Please remember that BODYTONE INTERNATIONAL SPORT S.L. reserves the right to withhold compensation in the form of a reduction of the refund amount for goods whose value has been diminished by evident overuse.

Please note: no goods will be accepted on a carriage-forward basis.
BODYTONE INTERNATIONAL SPORT S.L. reserves the right to refuse delivery at its premises of any product that has not been handled following the returns protocol.

The legal warranty on our products is 3 years from delivery of the item.

Accordingly, if you have received a defective item, you must contact BODYTONE INTERNATIONAL SPORT S.L. at atencionalcliente@bodytone.eu so that it can be repaired or replaced, the price reduced or the contract terminated.

This warranty will be excluded in the following cases:

Damage caused by transport or incorrect handling of the product.
Use or storage outdoors or in a damp environment.
Incorrect assembly.
Misuse or abnormal use.
Incorrect maintenance or lack of maintenance.
Repairs carried out by technicians not authorised by Bodytone.
Use for longer than the recommended usage (more hours per week than those specified in the item's instruction manual).

For warranty purposes, we recommend that you keep the original box for the first 2 months after purchase. If you do not have it, you must pack the product in a box of similar dimensions in line with Bodytone's quality standards.
Any machine collection service will be carried out kerbside, with the machine packed in its original box.
Regular maintenance is required to maintain the performance of the appliance and extend its service life.

Failure to comply with the maintenance conditions may cause premature wear and permanent damage, as well as invalidation of the warranty.

For purchases outside Spain, the legal warranty on our products is 2 years from delivery of the item.
Therefore, if you have received a defective item, you must contact BODYTONE INTERNATIONAL SPORT S.L. at atencionalcliente@bodytone.eu so that we can repair or replace it, reduce the price or terminate the contract.

The technical service and shipping costs inherent in reporting a fault or defect must be borne by the customer if it is ultimately determined that the fault is not the manufacturer's (BT) responsibility

BODYTONE INTERNATIONAL SPORT S.L. guarantees the privacy of the personal data provided, in accordance with the GDPR. Visiting this website does not oblige the user to provide any information about themselves; however, during the visit personal data may be requested through forms.

The use of our website and contracts for the purchase of products through the website shall be governed by Spanish law.

These General Conditions are subject to and shall be governed by the laws of Spain, in particular:

• Law 7/1998 of 13 April on General Contract Conditions,
• Royal Legislative Decree 1/2007 of 16 November approving the consolidated text of the General Law for the Protection of Consumers and Users and other complementary laws,
• Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC,
• Law 34/2002 of 11 July on Information Society Services and Electronic Commerce.

The parties submit, for the resolution of disputes and waiving any other jurisdiction, to the Courts and Tribunals of the consumer's place of residence.

Your complaints and claims will be handled by the customer service department as quickly as possible and, in any case, within a maximum of one month. They will also be logged under an identification code that will be notified to you and will allow you to follow them up.
