BODYTONE INTERNACIONAL SPORT S.L., with registered office at C/ Legón 4, 30500, Molina de Segura (Murcia), with CIF B-73591109, provides its electronic sales services on the Internet through its website http://www.bodytone.eu. The address for the purposes of complaints will correspond to that indicated as the company’s registered office.

These General Terms and Conditions (hereinafter General Terms and Conditions) shall govern the business relationship between BODYTONE INTERNACIONAL SPORT S.L. and the user or customer for the recruitment made through the forms that BODYTONE INTERNACIONAL SPORT S.L. makes available on its website / online store http://www.bodytone.eu.

Contracting through the website/online shop of BODYTONE INTERNACIONAL SPORT S.L. shall imply the acceptance by the client or user of the same,  as well as the conditions of use established for the user’s navigation through the pages owned by BODYTONE INTERNACIONAL SPORT S.L. These conditions shall apply without prejudice to the application of the legal regulations on the subject that may be applicable in each case.

These General Conditions are subject to the provisions of Law 7/1998 of 13 April on General Contracting Conditions, Royal Decree 1906/1999 of 17 December 1999, which regulates Telephone or Electronic Contracting with general conditions, the Organic Law 1581/2012 on the Protection of Personal Data, Law 7/1996 of 15 January on the Regulation of Retail Trade, and Law 3/2014 on Information Society Services and Electronic Commerce.

BODYTONE INTERNATIONAL SPORT S.L. reserves the right to make any changes it deems appropriate, without prior notice, to the General Conditions. Such modifications may be made, through its website/online shop, by any legally admissible means and shall be binding during the time they are published on the website and until they are validly modified by subsequent ones. However, BODYTONE INTERNACIONAL SPORT S.L. reserves the right to apply, in certain cases, Special Contract Conditions in preference to these General Conditions when it considers it appropriate, announcing them in due time and form.

The use of the page grants the use of the user and implies the acceptance of the conditions of the general conditions, privacy policy and conditions of use, if the user does not agree, he will refrain from using the page. The User is obliged and commits to use the page and its contents in accordance with the legislation in force, the general conditions and any other notice contained in this page, as well as with the rules of coexistence, morality and generally accepted good customs. The User is obliged and undertakes not to transmit, disseminate or make available to third parties any content of the Page, such as information, text, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software, logos, brands, icons, technology, photographs, software, links, graphic design and source codes, or any other material to which he has access in his capacity as a User of the Page, without this list being limitative.

The user, once registered as such on the website/online shop, which is essential for acquiring the products offered through them, has a personal area, identified as “My Account”, in which he can access the link “View or modify your data” and thus identify and rectify any errors made in entering data.

When the customer places an order, he/she will receive an e-mail with the web order form, which lists all the products he/she wishes to purchase, indicating the purchase prices and a link from which he/she can consult these contract conditions. Once the order request has been made, it will be processed and the customer will receive a second e-mail with the information about the person in charge of the order. If any situation related to the stock arises, variation of delivery time, etc…, we will contact the user or client via telephone or email in its absence to inform him/her at all times.

The order confirmation may be printed by the user as a proof of purchase, but it will not be valid as an invoice under any circumstances.

The order will be accompanied by the invoice at the time of delivery to the address. In the section “My Orders”, located on the home page in the section “My Account” the customer/user will also find a history of all orders placed with BODYTONE INTERNACIONAL SPORT S.L. By clicking on the order number, you will find the list of products purchased, the price and the method of payment.

All documentation provided to the customer will be formalized in Spanish.

All trademarks, trade names or logos of any kind that appear on the Website are the property of BODYTONE INTERNACIONAL SPORT S.L. or, where appropriate, of third parties who have authorized their use, and it may not be construed that use of or access to the Website and/or its contents gives the user any right over such trademarks, trade names and/or logos, and none of the exploitation rights that exist or may exist over such contents may be construed as having been assigned to the user. And it does not understand assigned nor its use is authorized, in any case, to the users of the Page unless these rights are obtained in writing from the legitimate owner of the same..

In compliance with current regulations, BODYTONE INTERNACIONAL SPORT S.L. offers in each of the sections, according to the type of product in question, information on all the articles for sale, descriptions, prices and approximate delivery time of the same. However, BODYTONE INTERNACIONAL SPORT S.L. reserves the right to withdraw, replace or change the products offered to its customers through its website/online shop, by simply changing the content of the website. In this way, the products offered at all times will be governed by the General Conditions in force in each case. Likewise, the company will have the right to stop offering, without previous notice and at any time, the access to the mentioned products.

The prices indicated on the screen are shown in euros and include VAT and any other tax that may be applicable, and will be the ones in force at all times, except in the case of a typographical error. Users or customers from the Canary Islands, Ceuta and Melilla will see the prices without VAT once they have registered or indicated their province in the purchase process.

Types of delivery:

-. DELIVERY AT STREET LEVEL

This is the default delivery mode. If the weight of your order is less than 40kg it is very possible that we will deliver it at home. If the weight is higher, we will arrange with you the delivery at the entrance of your house or apartment block. Remember that you will have to move and install the equipment yourself.

-. HOME DELIVERY PLUS PERSONALIZED INSTALLATION (ASK)

This method includes home delivery plus immediate installation of the equipment(s). Normally indicated for products of great weight or volume as well as home gyms that include several machines. We will take the machine(s) to the agreed place and time, install and test all the machines and remove the packaging to a recycling area. Bodytone.eu offers you different methods of payment so that you can choose the one that best suits you or your needs:

• Payment by Credit Card: you can use Visa or MasterCard. If you pay by VISA or MasterCard, your card will be charged at the time of purchase, that is, at the time of order processing. In the event that our virtual TPV informs of the refusal of the card, the order will be automatically cancelled, informing the customer of the cancellation online. For payments made with cards issued outside of Spain, it is necessary that the issuing bank is adhering to the Secure Electronic Commerce Security Protocol (CES). Bodytone.eu reserves the right to refuse any operation carried out with a credit card. In this case we will proceed to refund the cash on the original card. In these cases and if the client is interested in progressing with the purchase of the articles we will request a bank transfer.

• Payment by Transfer: This method of payment is limited to orders with an amount greater than 150 euros. You can make a bank transfer to any of the following accounts:

You have 7 working days to order the transfer after placing your order. The order will not be considered effective until we confirm the corresponding deposit and therefore, the delivery times start counting from this date.

• Pay in installments with Pay + Late: Pay in installments without the need for paperwork and in up to 12 convenient installments with Pay + Late. Select this payment method, complete the information required by Pay + Late and choose the installments in which you want to finance your purchase. To access the financing, it is essential to have a card to pay. Check the financing conditions and wait for the approval of Pay + Late, it will only take a few seconds! Once your application has been approved, the first instalment will be charged using the card provided and the remaining instalments will be charged monthly.

If your application is approved, you will be informed with complete transparency of the amount you will pay in each installment, as well as the interest rate (APR) that will affect your credit. All the instalments are fixed and equal to each other. There are no additional charges or commissions of any kind. You will only pay the amounts indicated according to the selected instalments..

• Payment by Paypal: The most secure online standard for making your payments.

In each of the products the user or customer will be able to see indicated the estimated shipping time (in working days) for that product. Saturdays, Sundays and national, regional and local holidays are not included in the shipping time.

The delivery time will correspond to the item with the longest delivery time. Possible delays that may occur will be communicated by BODYTONE INTERNATIONAL SPORT S.L. via email.

The availability of the products offered by BODYTONE INTERNATIONAL SPORT S.L. through its website may vary depending on customer demand. Although the company updates the stock periodically, the product requested by the customer may be out of stock at that time. In this case, BODYTONE INTERNATIONAL SPORT S.L. will send an email to the customer with all the information regarding stock and delivery times that the company can make available.

If the order contains more products in addition to the one affected by the lack of availability, the customer/user may cancel the entire order if desired or confirm the order except for the affected product.

The procedure for crediting the affected products will be carried out at the time of communication of the unavailability and will be reflected in your account without delay.

9.1 Return procedure:

In Bodytone we offer you up to 14 days of withdrawal

During the first 14 calendar days from the reception of the merchandise you can return the product/s for the money, in which case the transport and management costs will be discounted.

The refund period will correspond to 14 days from the date on which Bodytone has been informed of the withdrawal decision. However, the Company may withhold the refund until it has received the goods or until the Customer provides proof of the return of the goods. This will depend on which condition is met first.

9.2 Notes about returns:

We only accept unopened products with their original straps/seals. Once the merchandise is received, it will be checked by the corresponding department and we will proceed to refund the money or issue the voucher according to the modality or time elapsed.

BODYTONE INTERNATIONAL SPORT S.L. will not be responsible for returns on products handled by the customer. The right of withdrawal will not proceed outside the indicated period or on products subject to fluctuations of a market not controlled by BODYTONE INTERNATIONAL SPORT S.L., nor on perishable objects, objects that can be easily reproduced immediately, such as software or packages composed of these and/or included. Nor shall the withdrawal be applicable to goods or orders that may be considered for their special characteristics as requested by the customer.

9.3 Instructions for the return of products:

If you have any doubts about the correct delivery of the products to BODYTONE INTERNATIONAL SPORT S.L., please contact our Returns Department on +44 161 768 0021.

Returned goods must be securely wrapped and packaged, with their original packaging intact and covered by superior packaging, with all accessories and no traces of use of any kind. Remember that BODYTONE INTERNACIONAL SPORT S.L. reserves the right to withhold compensation in the form of a reduction in the price of reimbursement in exchange for goods whose value is diminished by obvious overuse.

A copy of the invoice for the order placed and the return slip provided by the technical service department must be attached to the article

In accordance with the provisions of Article 44 of Law 7/1996, of 15 January, on the Regulation of Retail Trade, the following articles are excluded from the refund system:

Due to their protective nature: Unsealed or unwrapped software, books and products with free software where it has been registered.

Due to its hygienic nature any product that cannot be resold, such as mats, foam rollers, as well as any product that comes into direct contact with body sweat.

Caution: No merchandise will be accepted with proper delivery. All returns must have the document “Return part” which reflects the return number assigned PEGADO ENCIMA DE LA CAJA.

BODYTONE INTERNATIONAL SPORT S.L. reserves the right to refuse delivery at our facilities of any product that has not been managed following the return protocol.

BODYTONE INTERNATIONAL SPORT S.L. has Complaint Forms available to the consumer.

Claims Sheet

The legal warranty of our products is 3 years from the delivery of the item.

Thus, if you have received a defective item, you should contact BODYTONE INTERNATIONAL SPORT S.L. through info@bodytone.eu to proceed with the repair, replacement, price reduction or termination of the contract.

This warranty shall be excluded in the following cases:

Damage caused by incorrect transport or handling of the product.
Use or storage outdoors or in a humid environment.
Incorrect assembly.
Misuse or abnormal use.
Incorrect maintenance or lack of maintenance.
Repairs carried out by technicians not authorized by Bodytone.
Use for longer than the recommended use (more hours per week than those determined in the instruction manual of the article).

For warranty purposes, we recommend that you keep the original box for the first 2 months of purchase. If you do not have it, you must pack the product in a box of similar dimensions according to Bodytone’s quality standards.
Any machine removal service will be performed on the street with the machine packed in its original box.
Periodic maintenance is required to maintain the performance of the machine and prolong its life.

Failure to comply with maintenance conditions may result in premature wear and permanent damage and may void the warranty.

For purchases outside of Spain, the legal warranty for our products is 2 years from the delivery of the item.
Therefore, if you have received a defective item, you should contact BODYTONE INTERNATIONAL SPORT S.L. through customerservice@bodytone.eu so that we can proceed with the repair, replacement, price reduction or termination of the contract.

BODYTONE INTERNACIONAL SPORT S.L. guarantees the privacy of the personal data provided, according to the GDPR. The visit to this website does not mean that the user is obliged to provide any information about himself, however during the visit it is possible that personal data will be requested through forms.

The relationship between the user and BODYTONE INTERNACIONAL SPORT S.L. shall be governed by the regulations in force and applicable in Spanish territory, and the courts of law of the territory in which BODYTONE INTERNACIONAL SPORT S.L. has its registered office shall be competent to decide on any dispute that may arise between the user and BODYTONE INTERNACIONAL SPORT S.L.

All our products must be kept out of the reach of children.

For all products with heart rate related functions: the heart rate values provided by the heart rate monitor or hand-held sensors are expressly designed to display heart rate only. Therefore, any other use, either diagnostic or medical, is excluded; it does not detect cardiac abnormalities or dysfunctions. The use of the heart rate monitor in the presence of a pacemaker or similar medical devices is not recommended.  The value may be altered in the case of drugs that can affect the heart rate. Always consult your doctor before starting a physical activity programme and before using specific devices with heart rate related functions.
